The rapper DMX, whose real name is Earl Simmons, was put back in the Maricopa County Jail last week for the sixth time. According to the Phoenix New Times, the rapper's most recent arrest is once again due to an alleged probation violation. He is currently being held behind bars without bail for the alleged offense and has a court date scheduled for November 24.
DMX will most likely want to have a Phoenix criminal defense attorney by his side in court tomorrow; since the rapper claims that his probation violation came about for taking just one sip of alcohol. However, court documents say that the rapper violated the terms of his probation for several different offenses; none of which are because of the man taking a sip of alcohol.
The arresting officer claimed that DMX violated his probation by using cocaine, using Oxycontin without a prescription, failing to submit to drug testing, failing to participate in counseling programs, failing to make payments, and driving on a suspended license.
As part of DMX's probation for a drug possession conviction, the man was reportedly enrolled in an 18-month drug and alcohol treatment program. Part of the program required DMX not to consume alcohol or do any drugs, which is a common requirement among court ordered drug and alcohol treatment programs. If a judge finds that a person has violated the terms of his or her probation, the defendant will often be sentenced to do time in jail.
